For the Petitioner/s : Mr. Niraj Kumar For the Opposite Party/s : Mr. Shailendra Kr.Singh(App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 Petitioner apprehends arrest in relation to Sachivalay Police Station (PS) Case No 4 of 2014 instituted under Sections 420, 467, 468, 471/34 of Indian Penal Code.

The allegation in the first information report is that the petitioner and the Section Officer had removed certain pages of a file to benefit a person against whom prosecution was pending and Government sanction was being processed. Learned counsel for the petitioner states that it is he who had initiated the matter for grant of sanction and it cannot be said with certainty that the file was in custody of the petitioner when the relevant papers were removed. It is also pointed out that the sanction has already been granted to prosecute the said person and no benefit could be derived by the said person because of absence of any file notings.

Patna High Court Cr.Misc. No.18245 of 2015 (2) dt.11-06-2015 The Section Officer has already been granted anticipatory bail by this Court in Cr Misc No 14296 of 2014 by order dated 26.05.2014.

It may be noted that petitioner had moved this Court earlier, but on technical ground, his application was rejected. Be that as it may, in the event of his arrest or surrender within four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Patna in Sachivalay PS Case No 4 of 2014 dated 08.01.2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
