Learned counsel for the complainant/informant is also present The petitioner is in custody since 25.05.2018 in connection with Siswan P.S. Case No. 217 of 2013 for the offence registered under Sections 406, 420, 467, 468, 323, 504, 506 and 120(B) of the Indian Penal Code.

The allegation against the petitioner is that he used to come along with the agent namely, Sabbir Ahmad, who has been colleting money from innocent investors in the village and thereafter, the petitioner

along with the said Sabbir Ahmad defrauded the investors and accordingly, the present complaint has been filed.

Learned counsel for the petitioner submits that the entire case is false and mischievous and the petitioner has been roped in this case falsely. It is further submitted that even as per the allegation, the alleged receipts were given by the said Sabbir Ahmad and the petitioner was just the person, who used to come with him and the story has been concocted that the petitioner was being handed over the money, which was being collected in lieu thereof certificates were issued in their favour.

Having heard learned counsel for the complainant and learned counsel for the petitioner, it appears that save and except the said allegation that the petitioner used to come along with the said Sabbir Ahmad, no allegation has been levelled. It is never the case of the complainant that the petitioner had also issued receipts for such deposits.

In view of such facts and circumstances of

the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicikal Magistrate, Siwan in connection with Siswan P.S.
