The petitioner seeks bail in a case instituted for the offences under Sections 379, 413, 414, 34 of the Indian Penal Code.

Prosecution case, in short, is that the informant on suspicion, signaled to stop the vehicle but on seeing police personnel, the accused persons tried to flee away but were apprehended. It is suspected that the accused persons deals in stolen property.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.10.2018. Chargesheet/prosecution report has been submitted in this case. There

Patna High Court CR. MISC. No.19468 of 2019(3) dt.01-05-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has been made accused due to mistake of fact. The petitioner had no knowledge that the vehicle in question was stolen property. The petitioner has got no concern with the vehicle in question. Other co-accused has been granted bail vide order dated 9.4.2019 passed in Cr. Misc. No. 22533 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.
