JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 324, 325, 326,307 of the Indian Penal Code and Sections 27,29 and 30 of Arms Act.
It is alleged that by the informant that when he was sitting with villagers, accused persons came and tried to take away Rakesh Singh to a particular place, which was protested , upon which Chhote Singh opened fire. Other accused persons also opened fire resulting in injury to Murari, Rakesh and Sanjay. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is not named in the FIR. The allegation of firing is not alleged against
Patna High Court Cr.Misc. No.27052 of 2015 (4) dt.01-10-2015 the petitioner. There is a counter version of the occurrence, which is evident from Annexure 2 to the present application. On behalf of the State and counsel for the informant, it has been submitted that the petitioner is not named in the FIR. The name of the petitioner has come in course of investigation. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, learned J.M., 1st Class, Patna City, District-Patna in connection with Gaurichak P.S.Case no. 244 of 2014,subject to the conditions as laid down u/s 438(2) Cr.P.C.
