The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 120B, 420, 406, 467, 468, 471, 323, 341, 379, 504/34 of the Indian Penal Code.
The prosecution case is that one Raghuvansh Singh gifted 02 katha 16 dhurs of land appertaining to plot no. 1212 to the mother of the informant Smt. Kunti Devi. The informant are four brothers. Subsequently, the land was partitioned among them, but the brother of the informant executed a sale deed with regard to the share of the informant in favour of petitioner no. 1, Bishesar Singh
Patna High Court Cr.Misc. No.23892 of 2016 (2) dt.26-05-2016 @ Bisheshwar Singh. Petitioner no. 2, Bikrma Singh @ Bikarama Singh being the brother of petitioner no. 1 has signed as identifier on the sale deed.
It is submitted by the learned counsel for the petitioners that petitioners are bona fide purchaser and the thrust of accusation is against brother of the informant namely Jawahar Singh. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sangrampur P.S. Case No. 67 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
