====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 16-11-2017 Heard Sri Kashyap Kaushal, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 20.06.2017 in Forbesganj P.S. Case No.446 of 2017 registered for the offence under Sections 399/402 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on false accusation, as if the petitioner with others had assembled to commit dacoity and was preparing for committing dacoity, the petitioner was arrested. He submits that the petitioner was arrested from the place, from where wine and knife were shown to be recovered. However, from none of the accused, any arms and ammunitions were recovered . He submits that after the petitioner was made accused in the present

Patna High Court Cr.Misc. No.55303 of 2017(2) dt.16-11-2017 2/2 case, subsequently, he was remanded in Forbesganj P.S. Case No.410 of 2017.

Considering the nature of accusation and period of custody, let the petitioner, namely, Anil Yadav be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.446 of 2017.
