The petitioner seeks bail in a case registered for the offence under Section 30(a) / 41 of Bihar Prohibition and Excise Act.

110 liters of country-made mahua liquor alongwith utensils and machine for preparation of liquor as well as one thousand fermented mahua have been recovered from a forest and petitioner & others are alleged to have fled away after seeing the police team.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion. Petitioner claims clean antecedent and he is in custody since 07.02.2022. Investigation is complete.

Patna High Court CR. MISC. No.17598 of 2022(2) dt.20-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court - 2, Nawada in connection with Rajauli P.S. Case No. 52 of 2021.
