This is an application for bail in connection with Sessions Trial No. 281 of 2017, arising out of Dinara P.S.Case No. 112 of 2017, registered for the offences punishable under Sections 302 of the Indian Penal Code and 27 of the Arms Act. Allegation as per FIR against the petitioner is of firing on the deceased and there is self confession of the petitioner also. Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence in the entire case diary and even pistol has not been recovered and he is in custody since 3.5.2017 and except self confession there is nothing against him. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.49939 of 2017 (3) dt.14-11-2017 2/2 circumstances, as stated above, and co-accused persons have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Rohtas at Sasaram, in connection with Sessions Trial No. 281 of 2017, arising out of Dinara P.S.Case No. 112 of 2017, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
