JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner apprehends his arrest in relation to Raniganj P.S. Case No. 209 of 2014 registered under Sections 409 and 420 of the Indian Penal Code by the Block Development Officer, Raniganj.

It is, inter alia, alleged that petitioner being an Assistant Teacher, was made In-charge for construction of Panchyat office, which was sanctioned to be constructed on the plot of public land, but instead he constructed the same on a private land of another person and paid the amount to the son of Mukhiya for the said construction causing loss to the Government. Learned counsel for the petitioner submits that the payment, that was made to the son of Mukhiya Ramanand Singh, was the payment in consideration of the construction that was carried out upon insistence of the

Patna High Court Cr.Misc. No.18292 of 2015 (2) dt.11-06-2015 2/2 Mukhiya. The Paynhayat office was constructed at a different place because it was the decision of the Mukhiya to get it done. He was in no position to oppose the same.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks from today, let the petitioner, namely, Rajnikant Ram be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria in connection with Raniganj P.S. Case No. 209 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Navaniti Prasad Singh, J.) Vats/- U T
