JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Raushanganj P.S. Case No. 154 of 2018, dated 17.10.2018, instituted for the offences under Sections 379/34 of the Indian Penal Code, Sections 4/21 of the MM (DR) Act, 1957, Sections 4/40 of BMMV Rule, 1972 and Bihar Minor Illegal Mining Transportation and Storage Rule 2006/08 and Section 15 of the Involvement Protection Act, 2016.

Many persons have been named in the F.I.R. for having lifted sand in an unauthorized manner. The petitioner is one of such named accused person.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.17017 of 2019(2) dt.27-03-2019 2/2 that his name has been provided by some local persons, who have definite animus against him.

Some of the other accused persons, similarly situated, have been granted anticipatory bail by different Benches of this Court, reference of which has been given in the bail application.

Considering the aforestated facts and the clean antecedents of the petitioner, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Raushanganj P.S. Case No. 154 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
