====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 13-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.4.2018 seeks bail in Murliganj PS Case No. 131 of 2018, NDPS PS Case No. 3 of 2018 registered under Sections 8/20 (b) (ii) (B) of NDPS Act. The allegation in brief is that the police apprehended two persons riding on the motorcycle and the person who was driving the motorcycle namely Manoj Yadav was carrying a bag from which two KG of Ganja was recovered.

Learned Counsel for the petitioner submits that the petitioner was pillion rider, he had taken lift on the motorcycle of Manoj Yadav, the recovery is not from the conscious possession of the petitioner rather from the possession of Manoj Yadav and the petitioner has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Chandra Kishore Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst, Madhepura in connection with Murliganj PS Case No. 131 of 2018, NDPS PS Case No. 3 of 2018.
