JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and Mrs. Binita Singh, SC-21, the learned counsel appearing for the respondent State.

The present writ petition has been filed for directing the respondent authorities to consider the case of the petitioner

Patna High Court CWJC No.5562 of 2020(2) dt.12-06-2020 2/2 pertaining to his transfer from the place of his posting to the place mentioned in his application in accordance with Rule 3 read with Rule 5 (kha) of Bihar Nationalised Elementary Teacher Transfer ( Disciplinary Action) Rules, 2018. At the outset, the learned counsel for the petitioner submits that the petitioner be granted liberty to approach the District Programme Officer (Establishment), Gaya i.e. the respondent No.6 for redressal of his grievances. The learned counsel appearing for the respondent State has got no objection.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to approach the respondent no. 6, for redressal of his aforesaid grievances, by filing appropriate representation within a period of four weeks from today, which shall be disposed of by the respondent no.6 within a period of six weeks thereafter by a reasoned and a speaking order.
