The petitioner, already in custody, seeks bail in connection with Bagengola P.S.Case No. 05 of 2018 registered under Sections 307/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that uncle of the informant, Collector Pandey, in the night, shot at his mother but did not hit her. Further this petitioner caught hold the informant and Collector Pandey shot at him by a country made pistol causing injury to him.

Submission is that specific allegation of shooting at the informant is only against Collector Pandey and petitioner has been falsely implicated in this case because of his relationship being brother-in-law of Collector Pandey and there is property

Patna High Court Cr.Misc. No.42324 of 2018(2) dt.16-07-2018 2/2 dispute in between informant and his uncle Collector Pandey and this petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Ram Ji Tiwari @ Ramji Tiwari is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Buxar in connection with Bagengola P.S. Case No. 05 of 2018.
