JUSTICE PURNENDU SINGH ORAL ORDER 15-07-2026 Heard Mr. Sunil Kumar, learned counsel appearing on behalf of the petitioner; Mr. Ram Kinkar Choubey, learned counsel for the informant and Mr. Raj Ballabh Singh, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Naya Bhojpur P.S. Case No. 120 of 2025 registered for the offence punishable under Sections 109(1), 303(2), 3(5) of the BNS and Section 27 of the Arms Act.

3. Mr. Ram Kinkar Choubey, learned counsel appearing on behalf of the informant has raised the preliminary objection with regard to maintainability of the pre-arrest bail in view of the fact that process under Sections 84 and 85 BNSS has already been issued against the petitioner.

4. The petitioner, if so advised, may surrender before the learned District Court and seek regular bail. In that case, the learned District Court may consider to disposed of the bail application of the petitioner on the same day on the basis of material which has come in course of investigation.

5. Accordingly, the present bail application stands disposed of.
