JUSTICE GOPAL PRASAD ORAL ORDER 15-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This is a petition for anticipatory bail for the offence under Section 47(A) of Excise Act and 468, 273 and other allied Sections of the I.P.C.

The matter relates to the recovery of 600 liters of liquor from the mango orchard of one Jay Prakash Kumar @ Bholu and when the police on secret information and led a search and he was called for interrogation then he started fleeing on seeing the police but on chase he was apprehended. Then it is alleged that on being secretly enquired from the people of the vicinity eight persons including the petitioner, named in paragraph 4 of the petition, are said to have been illegally engaged in

Patna High Court Cr.Misc. No.23750 of 2016 (2) dt.15-06-2016 2/2 manufacturing liquor. However, exact source of information that the liquor was in the possession of this petitioner has not been mentioned either in the impugned order or in the petition. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.R.Sahay, Sub Judge III, West Champaran at Bettiah, in Nautan(Jagdishpur) P.S.Case No.64/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
