JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Barhariya P.S. Case No. 273 of 2017 instituted for the offences under Sections 272, 273, 308/34 of the Indian Penal Code and Section 34(B) and 36/38 of the Bihar Excise and Prohibition Act, 2016.

The allegation is recovery of 22 litres of country made Mahua liquor from the possession of the petitioner. The learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. He is accused in one other case which is pending against him on same and similar accusation and he is on bail in the

Patna High Court Cr.Misc. No.60508 of 2017 (2) dt.21-12-2017 2/2 said case. It is further submitted that the petitioner is in custody since 28.08.2017.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeII, Siwan in connection with Barhariya P.S.
