The petitioner is apprehending his arrest in a case registered under Sections 420, 379, 34 of the Indian Penal Code and 7 of E.C. Act.

The prosecution case, in short, is that the certain quantity of wheat was misappropriated for black marketing by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is owner of the truck in question. The said truck is run as public carrier by the driver of the petitioner. The goods are booked by the transporter. The petitioner had no

Patna High Court CR. MISC. No.17100 of 2019(2) dt.28-03-2019 2/2 knowledge regarding the goods being booked by the transporter. There is shortage of about 200 kg of wheat which was loaded on the truck belonging to the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Vaishali at Hajipur in connection with Patepur P.S. Case No. 158 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
