Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Allegation against the petitioner and other named persons is of robbing the informant.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 15.02.2017. Investigation is already complete and the petitioner is ready to cooperate with the trial. Further submission is that none of the witnesses, before the police, have, even the eye-witness, supported the allegation of robbery committed by any one, rather they have stated that the petitioner committed assault against the informant. Considering the aforesaid facts, especially, the

No.60261 of 2017 (6) dt.08-03-2018 2/2 period already undergone and completion of the investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Shahebpurkamal Police Station Case No. 237 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
