The petitioner seeks bail in Maharajganj P. S. Case No. 16 of 2019 instituted for the offence under Section 414/34 of the Indian Penal Code.

Learned counsel for petitioner submits that he has been made accused merely on suspicion. From the seizure list, it appears that recovery of motorcycle has been made from a pitch road.

In the written report, it is alleged that police arrested this petitioner with motorcycle for which he could not produce any paper. The police has made the petitioner accused alleging that aforesaid motorcycle was stolen motorcycle. Learned counsel for petitioner submits that there is

Patna High Court CR. MISC. No.19657 of 2019(2) dt.01-04-2019 2/2 no case lodged with respect to theft of aforesaid motorcycle. Petitioner is in custody since 19.1.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM V, Siwan, in connection with Maharajganj P. S. Case No. 16 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
