JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhagwanpur P.S. Case No. 39 of 2018 instituted for the offence under Sections 147, 149, 323, 324, 379, 385, 384, 504, 506, 307, 420, 468 and 471 of the Indian Penal Code.

In the written report allegation against the petitioner is that he inflicted Farsa blow on the neck of the informant. The informant saved himself, but petitioner again inflicted Farsa blow on his head but informant saved the same stroke by raising his hand. Thereafter co-accused Raja Ram Choudhary inflicted blow with iron rod on the head of the informant, on account of which, he sustained bleeding injury and fell down on the ground. The injury report of the informant has been enclosed as

Patna High Court Cr.Misc. No.48733 of 2018 (2) dt.25-09-2018 2/2 Annexure-2 which shows that he sustained five injuries. All the injuries were simple in nature caused by hard and blunt substance.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S. Case No. 39 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
