The petitioner seeks pre-arrest bail in connection with Magadh Medical P.S. Case no. 36 of 2016 under sections 2( c), 3, 5(b) and 18 of the Mahua Flower Act and section 47(A), 13(F) and 48 of the Excise Act.

Regard being had to the recovery of certain quantity of liquor and Mahua flower kept for preparation of liquor from the house of the petitioner, I am not inclined to grant prearrest bail to the petitioner. Accordingly, this application for grant of prearrest bail under section 438 of the Code of Criminal Procedure, 1973 is dismissed.
