Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 504, 506 and 509 read with Section 34 of the Indian Penal Code and Sections 66(c)/66(D) I.T. Act.

As per the prosecution case, the informant has alleged that the petitioner used to threaten from abroad by the

Patna High Court CR. MISC. No.18023 of 2022(7) dt.28-02-2023 2/3 phone call and also threatened to kill the entire family of the informant if money was not credited to his account. The petitioner also threatened the informant that he would make video viral to tarnish of her reputation.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. Learned counsel has further submitted that the informant herself has made several calls to the petitioner from her mobile numbers and the petitioner has also made several calls to the informant which shows there is love affair between the petitioner and the informant. He has further submitted that the petitioner was being pressurized by the informant to solemnize marriage with her due to which this false case has been lodged against the petitioner. The petitioner has got clean antecedent as stated in para 3 of the bail petition.

Learned A.P.P. for the State and learned counsel for the informant have opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/ surrender within a period of six weeks from today, be

No.18023 of 2022(7) dt.28-02-2023 3/3 enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with Siwan Muffasil P.S. Case No. 150 of 2021, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

The application stands allowed.
