Petitioner seeks bail in a case registered for the offences punishable under Section 364 (A) of the Indian Penal Code.

The F.I.R. of the occurrence of kidnapping was lodged in the year, 1999. The name of the petitioner surfaced during investigation and charge-sheet was submitted, though the petitioner had not appeared in the case during investigation. Thereafter, the case of the petitioner was separated from some other co-accused at the stage of trial after declaring the petitioner as absconder on 08.07.2011 and thereafter the petitioner is in custody since 15.11.2016. The trial against the petitioner is at the stage of prosecution evidence.

No.44338 of 2018(2) dt.24-07-2018 2/2 Considering the entire facts aforesaid especially the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with S.Tr. No.71 of 2018, arising out of Semra Police Station Case No.01 of 1999, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
