The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 307 of the Indian Penal Code and 25(1B)a/26/27/35 of the Arms Act. The prosecution case is that on 08.02.2016 at 7.00 P.M. the petitioner, co-accused Pranav Kumar Singh, Prince Kumar and 2-3 unknown came at the door of the informant as they were looking for Dablu and Happu to kill them. The informant escaped from the scene and raised alarm when the villagers came and apprehended two persons. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.23812 of 2016 (2) dt.26-05-2016 2/2 petitioner that admittedly no injury was caused to anyone nor anything has been recovered from the possession of the petitioner. Though, the petitioner is accused in one other case but he is on bail.
Considering the nature of accusation, it is a case for consideration of prayer for regular bail by the learned court below, preferably on the same day since the apprehended accused has already been granted bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Buxar (Industrial) P.S. Case No. 18 of 2016 pending in the court of learned Chief Judicial Magistrate, Buxar.
With the aforesaid observation, this application is disposed of.
