====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.4.2018, seeks bail in Chakia PS Case No. 65 of 2018 registered under Sections 399, 402 of the IPC and Section 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that the police raided a place on secret information regarding assembly of some miscreants planning dacoity and recovered arms from possession of some of them and two motorcycles.
Learned Counsel for the petitioner submits that there is no recovery of any arms from the possession of the petitioner as well as any motorcycle rather the motorcycles were parked by some other persons and recovery is shown from the petitioner, the petitioner has no criminal antecedent and similarly situated another co-accused Shivam Kumar was earlier granted bail by this Court. Having considered the said facts and circumstances, the petitioner, namely, Kamlesh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XIII Motihari, East Champaran in connection with Chakia PS Case No. 65 of 2018.
