JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Balia P.S. Case No. 245 of 2014 for the offences instituted under Sections 302 and 201/34 of the IPC.

The prosecution story, in brief, is that on 14.07.2014 at 9.00 A.M., the informant Komal Devi, who was at her parental house received information from her neighbour of Sasural on telephone about the murder of her husband Rohit Thakur. She, with her father went to her Sasural and found the information true. The dead body of her husband was also disappeared. On query, the family member of her Sasural disclosed that her husband committed suicide by hanging. The informant suspected that the family members of her Sasural have committed murder of her

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the informant is the wife of the deceased. She is not an eye witness to the occurrence. There is no direct or indirect evidence against the petitioner. The petitioner is Gotia of the informant. It is further submitted that the petitioner had no dispute with the deceased. Hence, there is no reason for him to commit the alleged occurrence.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Balia P.S. Case No. 245/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
