JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Gangta P.S. Case No. 38 of 2018, disclosing offences under Sections 341, 323, 354(B), 376/511, 504/34 of the Indian Penal Code.
Allegation against the petitioner and others is of attempt to commit rape upon the informant, who is minor and when she protested, she was assaulted and when the neighbours came, they fled away.
Submission of learned counsel for the petitioner is that police after investigation has submitted final form not finding the case true against the petitioner. However, learned magistrate has taken cognizance but not against the petitioner. However, learned Special Judge has taken cognizance against the petitioner under Section 354 of the Indian Penal Code.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Gangta P.S. Case No. 38 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required by the Special Judge, otherwise, his bail bonds shall stand cancelled.
