2. The prayer for grant of anticipatory bail on behalf of Petitioner No. 1, namely Aman Kumar @ Aman Ram, has already been dismissed as withdrawn vide order dated 02.12.2024.
3. Petitioner Nos. 2, 3 and 4 apprehend their arrest in a case registered for the offence punishable under Sections 363, 365, 504 and 34 of the Indian Penal Code.
4. The prosecution case, in brief, is that on 06.06.2023 at about 5 AM, daughter of informant had gone to fields to

It is alleged that on 02.07.2023 daughter of informant called on mobile of son of informant from Mobile No. 9334947809 and told that she is going to Delhi. Prior to this incident, daughter of informant had earlier also fled away with co-accused Aman Kumar. It is alleged that co-accused Aman Kumar, with the help of these petitioners, kidnapped the minor daughter of informant. It is further alleged that when informant went to make complain, all the accused persons abused him.
5. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of kidnapping minor daughter of informant is against co-accused Aman Kumar. As a matter of fact, these petitioners have falsely been implicated in this case merely because they happen to be family members of coaccused Aman Kumar.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
7. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail
Patna High Court CR. MISC. No.20561 of 2024(6) dt.06-02-2025 3/3 to Petitioner Nos. 2, 3 and 4 is allowed.
8. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named Petitioner Nos. 2, 3 and 4 be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Lakhisarai in connection with Kajra P.S. Case No. 96 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
