2. The petitioners have preferred this application for grant of anticipatory bail in connection with Lakhisarai Mahila P.S. Case No. 33 of 2023 dated 17.04.2023, for the offences punishable under Sections 341/323/354/498A/494/504/506/34 of the Indian Penal Code & u/s 3/4 of the Dowry Prohibition Act.
3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have tortured the informant mentally and physically and ousted her from the matrimonial
Patna High Court CR. MISC. No.21558 of 2024(2) dt.18-04-2024 2/3 home due to non-fulfillment of demand of Rs. 5 Lacs. It is further alleged that the petitioner no. 2 (Bhaisur) had tried to outrage her modesty.
4. Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The petitioner no. 1 is the father-in-law, the petitioner no. 2 is the brother-in-law and the petitioner no. 3 is the sister-in-law of the informant. The petitioners have never demanded any dowry nor tortured the informant. The petitioners are ready to keep the informant with full dignity and honour. There is case and counter case between both the parties. The petitioners are completely separate from the mess and business of the husband of the informant.
5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioners, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of
Patna High Court CR. MISC. No.21558 of 2024(2) dt.18-04-2024 3/3 the like amount each to the satisfaction of the learned court concerned, Lakhisarai in connection with Lakhisarai Mahila P.S. Case No. 33 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
