The petitioner apprehends his arrest in Industrial Area P.S. case No. 180 of 2014 under Section 406, 409, 419, 420 of the Indian Penal Code.
The bank officials lodged the case making allegation that due to non payment of loan O. A. No. 183 of 2013 was filed in D.R.T. against investors, promoters and guarantors of Vaishali Fresh Fruits and Vegetables Pvt. Ltd and O. A. 183 of 2013 was allowed. R. P. No. 52 of 2014 was started for realizing the loan and attaching the properties of the company but it is alleged that promoters, investors and guarantors of the company took away machineries, fixtures and other articles of the company.

No.22668 of 2016 (3) dt.26-07-2016 2/2 It is submitted that petitioner is an employee of Vaishali Fresh Fruits and Vegetables Private Ltd. and the moment the company was sealed the petitioner was removed from service. The petitioner is neither investor nor promoter nor guarantor of the company.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Industrial Area P.S. Case No. 180 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
