Petitioner seeks bail in connection with Bagaha (Pathkhauli) P.S. Case No. 452/2017 for offences punishable under Sections 5, 6 of the Immoral Traffic (Prevention) Act, 1956.
The prosecution case, as lodged by the police personnel, is that on tip off that Suraj Guest House is used for immoral trafficking, the guest house was raided and from Room Nos. 101 and 103 two persons were found in suspicious condition with two women in each room. The petitioner was found in Room No. 103 of the guest house.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.51141 of 2017 (2) dt.03-11-2017 2/3 petitioner that he is innocent, bears no criminal antecedent and the lady is her cousin and no incriminating article was recovered except mobiles. He submits that he is neither the owner of the guest house nor any illegal act was being committed and he is languishing in judicial custody since 09.09.2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha (Pathkhauli) P.S. Case No. 452 of 2017, subject to the following conditions : (i) Both the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating their relationship with the petitioner.
(ii) Petitioner will cooperate with the investigation and will not induce the witnesses or tamper with the evidence.
