Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Prosecution's case in short is that petitioners who were Mukhiya of different Gram Panchayat, facilitated appointment of persons who got appointed on forged and fake academic certificates.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioners were members of counseling

No.17734 of 2022(2) dt.28-09-2022 2/3 committee who recommended appointment of the petitioners considering their academic certificates and there was no occasion for the committee to ascertain bona fide of these certificates at that stage. Moreover, issue of these appointments were collective decision as such petitioners cannot be held responsible for the illegal appointment. Similarly situated coaccused has already been allowed bail by a co-ordinate bench of this Court vide paragraph 12. Petitioners have got no criminal antecedent.

Learned counsel appearing for the Vigilance opposes the prayer for bail.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Banka in Dhuraiya Police Station Case No. 54 of 2019, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
