Petitioner seeks bail in connection with Gaya Rail P.S. Case No. 77 of 2018 registered for the offence punishable under sections 3, 5 and 18 of the Mahua Flowers Act. Learned counsel appearing for the petitioner submits that petitioner has been made a victim of circumstances in the present case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is from a bogie of train in which petitioner was travelling merely as a passenger. Petitioner has no concern with the alleged recovered items. Petitioner is a man of clean antecedent and is in custody since 01.04.2018.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.42884 of 2018(2) dt.19-07-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya in connection with Gaya rail P.S. Case No. 77 of 2018.
