JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-04-2019 The petitioner seeks bail in anticipation of her arrest in connection with Main P.S. Case No. 37 of 2018, dated 12.10.2018, instituted for the offences under Sections 363 and 365/34 of the Indian Penal Code.
The 17 years old daughter of the informant appears to have run away from her home, leading to the lodging of the subject F.I.R. The name of the petitioner has transpired in the F.I.R., but only on the basis of suspicion.
Patna High Court CR. MISC. No.18873 of 2019(2) dt.01-04-2019 2/3 The victim/daughter of the informant had been visiting the tailoring shop of the husband of the petitioner. The victim girl returned and has stated that the petitioner facilitated her in contacting one Abhimanyu with and for whom she voluntarily left her home.
The learned counsel for the petitioner has submitted that the victim girl has only come out with an excuse to satisfy her parents that an attempt was made to bring her and aforesaid Abhimanyu close by the petitioner. The fact of the matter remains that the victim girl had developed an affair with Abhimanyu and with whom she was caught. The victim/daugther of the informant has disclosed such facts in her statement recorded under Sections 164 Cr.P.C.
Considering the facts aforestated, the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two
