Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Lakhisarai P.S. Case No. 511 of 2009 corresponding to Sessions Trial No. 88 of 2019, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 04.03.2020. Vide order dated 10.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that out of 13

Patna High Court CR. MISC. No.27001 of 2021(3) dt.27-09-2021 2/2 prosecution witnesses 11 witnesses have already been examined and rest witnesses could not be examined due to Corona Pandemic.

Counsel for the informant vehemently opposed the bail application.

Considering the nature of accusation and substantive progress in trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected. However, trial court is directed to conclude the trial as early as possible.
