The Petitioner apprehends his arrest in Gogri P.S. Case No. 266 of 2015 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. The Informant, the father of the deceased lodged the case against unknown. The Informant has stated that his daughter had gone to the house of his neigbour for feast but she did not return in the night. On the next day, the dead body of his daughter was found inside the boundary-wall of Maheshwar Sharma.

Learned counsel for the petitioner submits that there is absolutely no material against the petitioner in para 59 of the case diary. The mother of the deceased only suspected that the petitioner has taken away the deceased and the petitioner is said to have threatened her of dire consequences.

No.23339 of 2016 (3) dt.28-07-2016 Similarly, in para 71 of the case diary the grand-mother of the deceased has stated the same facts that the petitioner had threatened the mother of the deceased but except suspicion the Investigating Officer has not yet collected any tangible material to show the involvement of the petitioner. Considering the facts aforesaid, the Petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Brajesh Kumar, Judicial Magistrate, 1st Class, Khagaria or his successor in connection with Gogri P.S. Case No. 266 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
