====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363, 366A/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner and one unknown person kidnapped daughter of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. As per the medical report, there is no sign of making physical relation. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail. He submits that He submits that the victim, in her

Patna High Court CR. MISC. No.23850 of 2025(3) dt.14-05-2025 2/2 statement recorded under section 164 of the Code of Criminal Procedure, has stated that the petitioner kidnapped the victim and took her to Delhi and forcibly established physical relation with her.

6. Considering the nature and gravity of allegation and aforesaid statement of the victim, prayer for bail of the petitioner is rejected.
