This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Madanpur PS Case No. 274 of 2018 for the alleged offence punishable under Sections 364, 302 and 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act. Allegation against the petitioner in the instant case is that he was providing the accused persons location of the police. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. He submits that petitioner is in custody since 06.11.2018.

Considering the fact that there is no allegation of overt act against the petitioner causing death of the victim in the

Patna High Court CR. MISC. No.17002 of 2019(2) dt.25-03-2019 2/2 instant case, the Court is inclined to grant bail to the petitioner subject to some condition. The application is accordingly allowed.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Aurangabad in connection with Madanpur PS Case No. 274 of 2018 subject to the condition that both the bailors should be the elected representatives of the local body.
