The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354(B), 379, 448, 504, 506, 34 of the Indian Penal Code and 27 of the Arms Act.
As per the F.I.R., the petitioner is alleged to have snatched silver chain from the neck of the informant and looted household articles and cash of Rs. 20,000/-.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. There is delay of 15 days in lodging of F.I.R, which makes the prosecution case doubtful. There is case and counter case between the parties. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.
Patna High Court CR. MISC. No.20145 of 2023(2) dt.24-06-2023 2/2 Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances and the fact that the there is delay in lodging the F.I.R., let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Bousi P.S. Case No. 164 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) sanjeev/- U T
