ANJANA MISHRA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 23.05.2018 in connection with Dumariya P.S. Case No. 33 of 2016 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner has been implicated in this case merely because he happens to be the elder son-in-law of the said Ramautar Ram whose daughter is alleged to have been found dead. It is further submitted that the petitioner had no concern with such family matters as described by the Chowkidar who discovered the body but only because he is closely related to the family he has been implicated in the present case.

Furthermore, the said

Patna High Court Cr.Misc. No.42664 of 2018 (2) dt.20-07-2018 2/2 Ramautar Ram and Yogendra Ram, father and brother of the deceased have already been granted regular bail and anticipatory bail passed in Cr. Misc. No. 37269 of 2016 and Cr. Misc. 1816 of 2017 vide order dated 08.11.2016 and 19.01.2017 respectively. In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Sherghati, (Gaya) in connection with Dumariya P.S. Case No. 33 of 2016.
