Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)A/26 and 27 of the Arms Act.
An occurrence of assault took place between two neighbours. The petitioner sustained injury and while the police searched the petitioner, he was apprehended in injured condition and a gun was recovered from possession of the petitioner along with cartridges.
Submission is that the petitioner has got no criminal antecedent. He is in custody since 19.03.2018. The petitioner has been implicated falsely by the police at the instance of the opponent. Investigation of the case is already complete.
Patna High Court Cr.Misc. No.44720 of 2018 (2) dt.01-08-2018 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chhatapur Police Station Case No. 71 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
