JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 42 of 2019, arising out of Palasi P.S. Case No. 06 of 2019, registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 475 ML of liquor from the house of the petitioner. It is also alleged that 21.3 litres of liquor has been recovered from the neighbouring house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated having no criminal antecedent.

No.18128 of 2019(2) dt.02-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Araria, in connection with Special Case No. 42 of 2019, arising out of Palasi P.S. Case No. 06 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
