JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 188/414 of the Indian Penal Code and section 52 of the Prisoners Act.

As per the prosecution case, during course of search of Mandal Kara(Jail), Hajipur, a mobile phone was recovered from the possession of the petitioner, who was in custody as under trial prisoner.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case because of some dispute with jail administration with respect to his remand in other case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Police Station Case No. 424 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
