The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 267 litres of Nepali Karishma wine was recovered from a Toyata four wheeler. It is further contended that there is no recovery from the physical possession of the petitioner, who has remained in custody since 16.09.2017, i.e., for about more than two months. Petitioner claims that he is having clean antecedent. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released

Patna High Court Cr.Misc. No.54648 of 2017(2) dt.23-11-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. II-cum-Special Judge (Excise), Sitamarhi in connection with Case No. C2/518/2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
