JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 457, 380 and 511/34 of the Indian Penal Code.

Counsel for the petitioner submits that as per the allegation itself the case is of failed attempt at theft. The petitioner was a labourer working in the construction of the premises from where he has been arrested. The petitioner is in jail custody since 14.08.2017 and he is a man of clean antecedent. He further submits that his presence at the place of occurrence was naturally and that he has been implicated only on the basis of suspicion In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
