Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Jaynagar P.S. Case No. 539 of 2018 (G.R. No. 1419 of 2018) registered for the offence under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.02.2023 and there is a recovery of 910 liters of country made wine.

Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.18031 of 2023(2) dt.10-05-2023 2/2 for bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Jaynagar P.S. Case No. 539 of 2018 (G.R. No. 1419 of 2018).

The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
