JUSTICE MADHURESH PRASAD ORAL ORDER 24-09-2019 The writ petition has been filed by the petitioner a candidate for selection as constable (GD) in CAPFS and Rifleman in Assam Rifles.

Petitioner' claim in the writ petition is that he had secured more marks than cut off marks prescribed in the process of selection, still he has not been selected. Learned Assistant Solicitor General appearing for the Union of India submits that marks obtained by the petitioner (61), was equal to the marks obtained by last selected candidate in OBC category of general area of Bihar State for preference 'C' (CRPF).

Tie has been resolved as per prescribed procedure for Resolution of Tie cases in terms of the advertisement itself. Claim of one Shashi Ranjan with whom there was a tie has been

No one appears on behalf of the petitioner.

Without going into merits of submission advanced on behalf of the respondents, writ petition is dismissed for want of prosecution.
