JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner, learned Additional P.P. as well as learned counsel for the complainant. The petitioner apprehends his arrest in Complaint Case no. 272(c)/2013, registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of D.P. Act. The wife has made allegation of demand of dowry and torture against the petitioner but the learned counsel for the petitioner submits that the petitioner is ready to keep his wife with full honour and dignity.

On above submission, Smt. Soni Srivastava, learned counsel for the complainant has submitted that she personally

Patna High Court Cr.Misc. No.28706 of 2015 (4) dt.13-10-2015 2/2 made all efforts for resolution of the disputes. The husband has not given any correct address. The wife is also willing to resolve the dispute amicably with the husband.

Considering the facts aforesaid and the fact that the husband and wife are willing to resolve the disputes amicably, the petitioner above named is directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order and on such the court below shall enlarge the petitioner on provisional bail for six months, after issuing notice to the complainant, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna in connection with Complaint Case No. 272(c)/2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and the court below shall make efforts for reconciliation between the husband and the wife. If the dispute is resolved, the provisional bail granted to the petitioner shall be confirmed and if the dispute is not resolved, the court below shall pass order in accordance with law on the provisional bail of the petitioner.
