The petitioner apprehends his arrest in connection with Kazi Mohammadpur P.S. Case No. 472 of 2019 for the offence registered under section 366(A) of the Indian Penal Code lodged on 12.11.2019 by the informant, Amrendra Prasad Singh.

The prosecution case in brief is that on the basis of written application of the informant the present case has been lodged for the alleged occurrence of kidnapping on 11.011.2019 at about 1:15 P.M. from Holy Cross Public School at Chhata Chowk, Muzaffarpur. It has been inter-alia alleged that after the school time was over, victim girl did not return to home and in

Patna High Court CR. MISC. No.17447 of 2023(2) dt.25-05-2023 2/2 the same school, the son of the informant who was also in the same school came home. Further, after search, it was found that the victim girl is present in the house of her friend one Sweta Kumari.

It is also alleged that victim girl used to do chatting with the petitioner on Facebook as also Facebook Messenger. Further, the informant got two mobile numbers and one whatsapp number of the petitioner which are 9525618153, 6369928163 and 6369928176. It has been lastly alleged that the petitioner has taken away the victim girl by inducement. Accordingly, the FIR.

Considering the fact that the matter is of abduction of the year 2019, the petitioner moved before the learned Sessions Judge in 2020 which was rejected chose to leisurely walk to Patna High Court and filed petition only in 2023, certainly this is not a fit case for grant of anticipatory bail, which is accordingly rejected.
