The petitioner seeks bail in Chakia P.S. Case No. 322 of 2021 registered for the offence under Sections 366, 366(A) and 34 of the Indian Penal Code.
As per the prosecution case, it is alleged that petitioner took away daughter of the informant with the help of one Reshmi Devi.
It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. It is further submitted that from perusal of statement of the victim recorded under Section 164 Cr.P.C., she clearly stated that she went with the petitioner out of her own sweet will and she was not kidnapped. It is further submitted that medical board has assessed the age of the victim as 18 to 19 years.

Learned APP vehemently opposes the prayer for bail of the petitioner.
Considering the aforesaid facts and circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Motihari, East Champaran in connection with Chakia P.S. Case No. 322 of 2021. (Prabhat Kumar Singh, J) Ankit/- U
